Libertarian legal giant Randy Barnett says Trump's Supreme Court nominee is a serious, smart guy. But will he restrain government?

Barnett, Carmack Waterhouse Professor of Legal Theory and Director Georgetown Center for the Constitution, sat down with Reason TV to weigh in on Trump's nomination of Neil Gorsuch to the Supreme court.

Barnett said he was cautiously optimistic about Gorsuch. "Of all the people on [Trump's] list, he was certainly near the top," Barnett said.

He said Gorsuch seems to be well read, smart, and a staunch defender of originalism like Justice Scalia.

"There's the old 'framers intent,' which people say if they don't know what they're talking about," Barnett said. "Gorusch says 'original public meaning,' which means he knows what he's talking about."

Barnett said he believes the addition of Gorsuch to the Supreme court could have a significant impact on whether or not a reinterpretation of abortion rights is in the future.

Reuters reports it was the closest vote—by a wide margin—for a secretary of state nominee in at least a half-century. The Senate Judiciary Committee also approved the nomination of Senator Jeff Sessions to be attorney general in a straight party-line vote. Democratic lawmakers on the Senate Finance Committee boycotted committee votes on two of Donald Trump’s Cabinet picks: Steven Mnuchin for treasury secretary and Tom Price for health and human services secretary. The committee rules require at least one Democrat present to vote. Republicans on the committee then suspended the rules and voted to send the two nominations to the Senate floor. Democrats on the Environment and Public Works Committee also boycotted a vote on Scott Pruitt to become head of the Environmental Protection Agency.

The Pentagon now acknowledges that civilians were killed Sunday when members of the Navy’s SEAL Team 6 joined with commandos from the United Arab Emirates to raid a Yemeni village where members of al-Qaeda were said to live. But human rights groups say up to 24 civilians were killed, including a newborn baby and an American 8-year-old girl, Nawar al-Awlaki, the daughter of the U.S.-born cleric Anwar al-Awlaki, who was killed in Yemen by a U.S. drone strike in 2011. The U.S. suffered one fatality: William "Ryan" Owens, a veteran member of SEAL Team 6. We get response from Jeremy Scahill, co-founder of The Intercept, who has extensively covered Yemen; Pardiss Kebriaei, staff attorney with the Center for Constitutional Rights; and Baraa Shiban, the Yemen project coordinator and caseworker with Reprieve.
